BEd, DElEd Supreme Court: The issue of recruitment of primary teachers to 2,600 posts in Uttarakhand has again reached the Supreme Court. BED candidates have challenged the High Court's decision in the Supreme Court on a petition by Binmaya Mal, a resident of Udham Singh Nagar.
Supreme Court advocate Dhananjay Garg said the department had invited applications from B.Ed candidates for the recruitment of teachers, but these candidates were excluded from the recruitment process. Binmaya Mal of Udham Singh Nagar filed a petition in the Nainital High Court that all BEd candidates should be excluded from primary teacher recruitment based on the Supreme Court order dated August 11, 2023.
In the petition, the High Court had ordered the exclusion of BEd candidates from the primary teacher recruitment on 14 December 2023. After this order of the High Court, the jobs of the selected BE candidates are in jeopardy. At the same time candidates who applied for the recruitment are excluded from the recruitment process. After this order of the High Court, the education department is also preparing to change the teacher recruitment service rules.
Even though the Department of Education sought instructions from the government, the B.D. candidates approached the Supreme Court against the decision of the High Court before the government took any decision. On behalf of the B.Ed candidates, Jayveer Singh, Priyanka Rani and Umesh Kumari of Roorkee challenged the Nainital High Court order in the Supreme Court.
The petitioners say the government should not amend the employment rules until a decision is taken on the ongoing recruitment of primary teachers. The government should file a special appeal in the Supreme Court to complete the recruitment process by including BED candidates in the current recruitment.
